Terms of Use (EULA)

1. Agreement to Terms

Welcome to Kurb AI (the "App," the "Service," "Kurb," "we," "us," or "our"). The App is published by Axiom Trinity Labs, LLC ("Axiom Trinity Labs"). By downloading, installing, or using Kurb AI, you agree to be bound by these Terms of Use ("Terms"), which include the End User License Agreement set out below.

If you do not agree to these Terms, do not download, install, or use the App.

These Terms are a legally binding agreement between you and Axiom Trinity Labs, LLC. We may update them at any time. Continued use of the App after a change constitutes acceptance of the updated Terms.

2. Eligibility

To use Kurb AI you must:

• Be at least 13 years old;
• Have the legal capacity to enter into a binding contract;
• Not be barred from using the Service under U.S. or applicable foreign law; and
• Not be located in a country embargoed by the U.S. government or listed by the U.S. government as a "terrorist supporting" country.

If you are under 18, you confirm you have permission from a parent or legal guardian to use the App.

3. Your Account

Kurb AI signs you in with Sign in with Apple or Sign in with Google. You are responsible for keeping access to your Apple ID or Google Account secure. You are responsible for everything that happens under your Kurb AI account. We may suspend or terminate your account if you violate these Terms, attempt fraudulent activity, or for any other reason in our reasonable discretion.

4. Subscription and Payment

4.1 Plan

• Kurb AI Annual — $39.99 USD per year, with a 3-day free trial for first-time subscribers.
• The price displayed in the App at the time of purchase is controlling, and may vary by country or applicable taxes.
• The annual plan is the only paid plan offered at this time.

4.2 Free trial

New subscribers receive a 3-day free trial. If you do not cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid annual subscription at $39.99/year. You will not be charged during the trial.

4.3 Auto-renewal

Subscriptions automatically renew each year unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for the renewal within 24 hours prior to the end of the current period.

4.4 Cancellation

You can cancel your subscription at any time in your iOS Settings:

Settings → [Your Name] → Subscriptions → Kurb AI → Cancel Subscription.

Cancellation takes effect at the end of the current billing period; you keep access to paid features until then. No partial refunds are issued for unused time.

4.5 Refunds

All payments for Kurb AI are processed by Apple through the App Store. Refund requests must be made directly to Apple (Settings → [Your Name] → Media & Purchases → View Account → Purchase History → Report a Problem, or via reportaproblem.apple.com) and are decided by Apple under Apple's policies. We do not have the ability to issue refunds directly.

5. License Grant

Subject to your compliance with these Terms, Axiom Trinity Labs, LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use Kurb AI on an Apple-branded device that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, for your personal, non-commercial use only.

6. Acceptable Use

6.1 Permitted use

You may use Kurb AI to block selected food-delivery apps, complete the Confession Gate to unlock them, and view your personal stats.

6.2 Prohibited activities

You agree NOT to:

• Use the Service for any unlawful, harassing, or fraudulent purpose;
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent applicable law expressly permits despite this limitation;
• Bypass, disable, or interfere with the App's security or rate-limiting features;
• Submit content to Kurb AI (including confession messages and screenshots) that is illegal, threatening, defamatory, or that violates a third party's rights;
• Add a person as your accountability buddy without their permission, or use the App to send unwanted, harassing, or abusive messages to anyone;
• Submit screenshots that depict illegal content, sexual content, content involving minors, or another person's private information without their consent;
• Create multiple accounts to circumvent subscription or trial limits;
• Share your account credentials with others, or sell or transfer your account;
• Scrape, copy, redistribute, or commercially exploit any part of the Service;
• Use automated systems (bots, scripts) to access the Service.

6.3 Content removal

We reserve the right to remove any user-submitted content (including confession messages and screenshots) that violates these Terms, in our sole discretion.

7. Intellectual Property

7.1 Our ownership

The App, including the source code, design, copy, AI prompts, the "Kurb" and "Kurb AI" word marks, and the K monogram logo, is owned by Axiom Trinity Labs, LLC and is protected by copyright, trademark, and other intellectual property laws.

7.2 Your content

You retain ownership of the screenshots and other content you submit. By submitting them, you grant Axiom Trinity Labs, LLC a limited, non-exclusive, royalty-free license to process them through the AI provider that powers Kurb AI, solely for the purpose of generating your confession message and verifying that you sent it to your buddy. We do not use your content to train any AI model, and we do not sell or share your content with advertisers.

7.3 Trademarks

"Kurb," "Kurb AI," and the K monogram are trademarks of Axiom Trinity Labs, LLC. You may not use our trademarks without prior written permission.

8. AI Output, Accuracy, and No Coaching

8.1 AI-powered service

Kurb AI uses an artificial-intelligence model to generate your accountability ("confession") message and to review the screenshot you submit as proof that you sent it to your buddy. AI is imperfect by nature.

8.2 No guarantees

We do NOT guarantee:

• 100% accuracy of any AI-generated message or screenshot review;
• Specific outcomes for your spending, weight, or habits;
• Error-free or uninterrupted operation of the Service;
• That the App will block every version of every delivery service indefinitely.

8.3 Not medical, nutrition, or financial advice

Kurb AI is a behavior-change tool, not a medical, nutrition, or financial advisor. It helps you reduce food-delivery spending; it does not provide health, dietary, or financial advice. You are responsible for your own spending and dietary decisions, and should consult an appropriately licensed professional where you need advice.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Third-Party Services

The App integrates with the following third-party services:

• Apple — App Store, Sign in with Apple, in-app payments, Family Controls (the OS feature that blocks the delivery apps), the system contact picker, the Messages compose sheet, and push notifications.
• Google — Sign in with Google (only if you choose this option).
• Supabase — database, authentication, and file storage on our behalf.
• Google Gemini API — the underlying large-language and vision model that powers the in-app feature we call "Kurb AI." Your aggregate stats (used to generate the confession message) and the proof screenshot you upload are sent to this API by our server.
• RevenueCat — receives subscription events from Apple and reports them to us.

Each of these providers has its own terms and privacy policy. We are not responsible for their practices or availability.

11. Termination

11.1 By you

You may stop using the App and terminate this agreement at any time by canceling your subscription (Section 4.4) and deleting your account inside the App (Settings → Account → Delete account).

11.2 By us

We may suspend or terminate your access immediately if you violate these Terms, if we detect fraudulent activity, if required by law or government request, or if we discontinue the Service.

11.3 Effect of termination

Upon termination your right to use the Service ceases. Any active subscription will continue until the end of the paid period unless canceled earlier through Apple. Account data is deleted within 30 days (see the Privacy Policy). Sections that by their nature survive (e.g., Sections 7, 8, 12, 13, 14, 15) continue to apply.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXIOM TRINITY LABS, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $39.99, WHICHEVER IS GREATER.

We are not liable for any injury or damage resulting from your participation in any challenge, your use of the App while operating a vehicle, your failure to follow your healthcare provider's advice, or third-party actions (including changes to Apple's, Google's, or delivery providers' policies).

14. Indemnification

You agree to indemnify, defend, and hold harmless Axiom Trinity Labs, LLC and its officers, members, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your violation of these Terms, (b) your violation of any third-party right, including any intellectual-property or privacy right, or (c) your misuse of the Service.

15. Dispute Resolution

15.1 Informal resolution

Before filing any claim, please contact us at team@trykurb.app and give us 30 days to resolve the issue informally.

15.2 Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15.3 Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court.

15.4 Class-action waiver

You agree to resolve disputes individually and waive the right to participate in class actions, class arbitrations, and representative actions to the maximum extent permitted by law.

16. Apple-Specific Terms (EULA)

The following terms apply specifically to your use of Kurb AI on an Apple device. They are required by Apple and, in the event of conflict with the rest of these Terms, control with respect to Apple.

1. Acknowledgement. You acknowledge that these Terms are concluded between you and Axiom Trinity Labs, LLC only, and not with Apple Inc. ("Apple"). Axiom Trinity Labs, LLC, not Apple, is solely responsible for Kurb AI and its content.
2. Scope of license. The license granted to you for Kurb AI is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Kurb AI may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
3. Maintenance and support. Axiom Trinity Labs, LLC is solely responsible for providing any maintenance and support services with respect to Kurb AI, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Kurb AI.
4. Warranty. Axiom Trinity Labs, LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Kurb AI to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Kurb AI, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Axiom Trinity Labs, LLC.
5. Product claims. You acknowledge that Axiom Trinity Labs, LLC, not Apple, is responsible for addressing any claims by you or any third party relating to Kurb AI or your possession and/or use of Kurb AI, including, but not limited to: (i) product-liability claims; (ii) any claim that Kurb AI fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation.
6. Intellectual-property rights. You acknowledge that, in the event of any third-party claim that Kurb AI or your possession and use of Kurb AI infringes that third party's intellectual-property rights, Axiom Trinity Labs, LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual-property infringement claim.
7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

17. Changes to These Terms

We may modify these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, for material changes, notify you in-app or by email. If you do not agree to an update, you must stop using the App and may cancel your account.

18. General Provisions

• Entire agreement. These Terms, together with the Privacy Policy, form the entire agreement between you and Axiom Trinity Labs, LLC concerning Kurb AI.
• Severability. If any provision is unenforceable, the remaining provisions remain in full effect.
• No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms. We may assign them to an affiliate or successor.
• Force majeure. We are not liable for any failure to perform due to circumstances beyond our reasonable control.
